1. About These Terms

These Terms and Conditions apply to all services provided by Fran Hamilton ("I", "me", "my") and to the use of this website.

By booking, purchasing or engaging with my services, you agree to these Terms and Conditions.

Services may include:

  • Occupational therapy consultancy

  • Dementia consultancy

  • Training and education

  • Facilitation and project work

  • Speaking engagements

  • Coaching and mentoring

  • Support for individuals, families and carers

  • Workshops and group activities

  • Resource development and written materials

Where a separate agreement or proposal is provided, that agreement will take precedence where applicable.

2. Bookings and Agreements

A booking is confirmed when:

  • Written acceptance of a proposal is received;

  • A booking form is submitted;

  • A purchase order is issued; or

  • Arrangements are confirmed by email.

Quotations are valid for 30 days unless otherwise stated.

3. Fees and Payment

Fees will be agreed in advance.

Unless otherwise agreed:

  • Invoices are payable within 30 days.

  • Payment should be made by bank transfer.

  • Agreed travel, accommodation or venue expenses may be charged in addition to service fees.

Late payments may incur interest and recovery costs in accordance with applicable legislation.

4. Cancellation and Rescheduling

If you need to cancel or rearrange a booking, please provide written notice as soon as possible.

The following charges may apply:

Notice Given and Fee Payable

  • More than 28 Days Notice - No charge

  • 14-28 Days Notice - 50% of agreed fee

  • Less than 14 Days Notice - 100% of agreed fee

Reasonable expenses already incurred may also be charged.

If I need to cancel due to illness, emergency or circumstances beyond my control, an alternative date will be offered where possible or any fees paid for the affected service will be refunded.

5. Delivery of Services

Services will be delivered with reasonable care, skill and professionalism.

Whilst I aim to provide high-quality advice, education and support, I cannot guarantee specific outcomes, organisational improvements or individual results arising from the implementation of recommendations or training.

6. Online Sessions

Clients are responsible for ensuring they have suitable internet access, equipment and access to any agreed online platform.

I am not responsible for technical difficulties beyond my reasonable control.

7. Intellectual Property

All training materials, presentations, resources, reports, tools, templates and content remain my intellectual property unless otherwise agreed in writing.

Materials may be used for personal or organisational learning purposes only.

They may not be copied, shared externally, adapted, sold or used to deliver training without prior written permission.

8. Confidentiality and Safeguarding

Information shared during consultancy, training, support sessions or projects will be treated confidentially.

However, confidentiality may be breached where:

  • There is a safeguarding concern;

  • There is a risk of serious harm;

  • Disclosure is required by law.

Safeguarding the wellbeing of adults and others who may be at risk is a priority within all services.

9. Professional Boundaries

My services are intended to provide education, consultancy, guidance and support.

Unless specifically agreed in writing, services do not constitute:

  • Medical diagnosis

  • Medical treatment

  • Psychological therapy

  • Legal advice

  • Financial advice

Individuals remain responsible for seeking appropriate professional advice relevant to their circumstances.

10. Photography, Recording and Testimonials

Training sessions, workshops and events may not be recorded without prior permission.

Testimonials, feedback and anonymised case studies may be used for service improvement and promotional purposes with appropriate consent.

Identifiable information will never be published without permission.

11. Associates

I reserve the right to engage appropriately qualified associates or subcontractors where necessary to support service delivery.

Any associates will be required to comply with professional, confidentiality and data protection requirements.

12. Limitation of Liability

To the fullest extent permitted by law, I shall not be liable for indirect, consequential or financial losses arising from the use of my services or website.

My total liability in relation to any engagement shall not exceed the fees paid for that engagement.

Nothing in these Terms excludes liability that cannot legally be excluded under the laws of England and Wales.

The content on this website is provided for general information purposes only.

Whilst reasonable efforts are made to keep information accurate and up to date, no guarantees are given regarding completeness or accuracy.
